Terms & Conditions
1. General
The term ‘Company’ refers to The Handmade & Hire Company Limited. The ‘Hirer’ is any individual or entity engaging in the hiring of goods from the Company. ‘Goods’ or ‘equipment’ denotes items provided by the Company in accordance with the standard Terms and Conditions of hire.
2. Acceptance of Conditions
The acceptance of goods on hire indicates the Hirer’s agreement to the following Conditions of Hire, either through signing or payment for the order. A copy of the Company’s Terms and Conditions will be provided upon booking and must be signed by the Hirer.
3. Retention of Title & Sub-hire
All goods supplied by the Company, herein referred to as ‘The Handmade & Hire Company Limited,’ remain the property of the Company at all times. The Hirer agrees not to sell, offer for sale, assign, charge, pledge, underlet, lend, or otherwise deal with the equipment, unless otherwise agreed with the Company.
Under no circumstances may the Company’s items be sub-hired or used for an event other than the one specified during booking. In the event of the Company becoming aware of sub-hiring situations, the Hirer’s security deposit will be forfeited, and future hiring privileges will be revoked.
4. Refusal
The Handmade & Hire Company Limited reserves the right to decline equipment hire to individuals or entities if there is a suspicion of potential misuse or disrespectful treatment of the items. Such decisions will be made at the discretion of the Company.
5. Payment
To confirm a booking with The Handmade & Hire Company Limited, a non-refundable deposit of 50% of the total hire charge, plus the security deposit (if applicable), is required upon booking, unless an alternative amount is specified on the invoice. The full hire amount is due seven days before the commencement of the hire period. An invoice reflecting this amount will be sent to the Hirer.
Failure to make the full payment within seven days, without prior written cancellation, will render the Hirer liable for the entire payable amount.
Payments are to be made via bank/BACS transfer or alternative methods previously agreed upon with the Company.
6. Security Deposit
A security deposit is mandatory for all hired items and is payable at the time of booking, typically via BACS transfer, unless otherwise agreed with the Company. The security deposit amount, generally set at £50, will be confirmed in advance and specified on the invoice.
Should the cost of repairs or replacements be lower than the security deposit paid, a refund for the unused balance will be issued. In cases where the security deposit falls short of covering repair or replacement costs, the Hirer will be invoiced for the outstanding amount, with a 14-day payment window.
The security deposit (minus any damage/missing costs) will be refunded within 21 days of the event. While every effort is made for prompt returns, delays may occur during peak periods. Signing this agreement indicates acceptance of the security deposit terms.
7. Booking Form
Upon payment of the deposit and confirmation of booking with the Company, a booking form will be provided to the Hirer. It is the Hirer’s responsibility to accurately complete this form with detailed information, including dates, times, venue details, and any additional instructions or information.
8. Items for Hire
We take pride in offering high-quality equipment for hire. While our items are in good used condition, they may not be perfect due to their handmade nature and previous use. Imperfections such as paint chips, rust, stains, or fraying may be present. As the Hirer, it is your responsibility to assess and confirm satisfaction with the item’s condition upon delivery. Acceptance must be acknowledged by a responsible adult over the
age of 18.
Please note that the responsibility for hired items remains with the Hirer until they are collected by the Company. Ensure that all items are kept dry and secure during this period, and that food, drink, and unsupervised children are kept away from the items at all times.
Unattended items are also the responsibility of the Hirer during the entire hire period. Any lost, damaged, or stolen items will incur replacement costs. Once the Company has set up the hire items, they are to remain in the same position and not be moved under any circumstances to prevent damage or safety hazards.
Any request to place hire items outdoors requires prior agreement and is weather-dependent. In case of adverse weather forecasts, alternative arrangements need to be agreed upon. If no suitable option is available, the Company reserves the right to refuse hire without issuing a refund.
The Company’s insurance does not cover the Hirer for loss or damage to items. We strongly recommend obtaining personal event insurance to ensure coverage in case of any unforeseen incidents.
All of our items undergo a risk assessment, and their condition is assessed before and after the hire. However, the Company accepts no responsibility for any injury or damage caused by our items while under the Hirer’s supervision.
All electronic items will be tested before the event. While we aim to resolve any issues that arise before the start of your event, we cannot predict electrical faults. If notified immediately with photographic or The Handmade & Hire Company Limited videographic proof and our equipment is proven faulty and not immediately fixable upon testing, we can issue a refund for the affected item.
No alterations to the Company’s hire items are permitted without prior authorisation. Unauthorised amendments will incur charges, and the Hirer will be liable for any breakages, with replacement costs invoiced.
In the rare event that a hired item becomes unavailable, the Company will inform the Hirer and attempt to provide a suitable alternative. If dissatisfaction arises, the Company will work with the Hirer to find a mutually agreeable solution. By signing this agreement, the Hirer acknowledges that compensation cannot be claimed if an item becomes unavailable due to circumstances beyond our control, and the offered replacement is deemed unsuitable.
9. Personalised/Sourced Items
If handmade or personalised items are specifically ordered for a Hirer, no refunds or exchanges will be provided if the items are no longer required or unused. For personalised items, the Company will request wording digitally via email or messaging to ensure accurate creation. Once the proof has been agreed upon, the Company is not liable for any mistakes or spelling errors.
In cases where the Company is asked to source items specifically for an event and they are no longer required, no refunds or exchanges will be provided.
10. Delivery & Collection
The Handmade & Hire Company Limited endeavours to arrive at the agreed setup time, but in unforeseen circumstances beyond our control (e.g., adverse weather or traffic), the Company cannot be held liable. We will keep the Hirer informed as much as possible.
The Hirer is responsible for ensuring that the venue authorises the installation of hired items. If a venue refuses installation, no refund will be given.
Upon delivery, items will be unloaded and set up in the agreed area. Driving on grass or fields in wet weather is not possible; hardstanding areas must be available. If vehicle access requires driving across an area without hardstanding, this must be agreed upon before booking.
Delivery & collection points must be pre-arranged with good vehicular access, considering height restriction barriers. The Company needs at least 1 hour for setup unless otherwise agreed.
The Hirer must ensure venue access at the agreed time and that someone with a plan of action is on site to meet us.
Items will be collected at an agreed time; charges may apply if items are not ready for collection. The Hirer is responsible for keeping items dry and secure until collected. If items are missing and cannot be collected, a 48-hour return period is allowed; after that, replacement charges will apply.
Please report any issues or damage at the time of collection. Failure to do so may result in the non-return of the security deposit and additional charges. The Hirer must allocate space for a large van and trailer during drop-off and collection, ensuring they are not more than 25 meters away from vehicles. Any restrictions or obstacles (stairs, bollards, parking, etc.) must be notified to the Company to facilitate delivery.
11. Condition of Items at the End of Hire
At the end of the hire, all items should be clean, dry, and in the same condition as delivered. Cleaning, if required, should only be done with anti-bacterial wipes; harsh products or chemicals should not be used on any items/equipment.
Failure to return items in the same state may incur a cleaning fee, charged at the Company’s discretion within 7 days of the event.
12. Payment for Damaged or Missing Items
The Hirer assumes full responsibility for any loss of or damage to hired products for their event, excluding standard wear and tear. In the event of damaged or missing items, the Hirer agrees to pay the full cost of replacing the equipment with new stock. If the item is on hire the next day, the Hirer may also be liable for loss of earnings. Failure to comply constitutes a breach of these terms and conditions, and legal action may be pursued by the Company.
13. Booking, Cancellations & Amendments
All cancellations must be submitted in writing; no other form will be accepted. If the Hirer cancels more than 30 days before their booking, no charges will apply, and the 50% deposit will be refunded in full. Cancellation after this period will result in the 50% deposit not being refunded, unless extreme circumstances warrant Company discretion.
In case of a date change, subject to availability, the Company can transfer the deposit to an alternative date within 6 months of the original booking. Amendments to orders are allowed before the final instalment is paid. Any changes after full payment may be made but will not be refundable. Additional items costing more than the original invoice will incur an additional invoice, and new items can be added (subject to availability) until the week of the hire period.
14. Adverse Weather
Outdoor items (e.g., our Photobooth Caravan) are intended for outdoor use, and it is the Hirer’s responsibility to ensure protection during adverse weather. The venue must have suitable shelter or an agreed alternative solution for using outdoor equipment if weather conditions prevent safe outdoor use. Adverse weather conditions on the event day that render outdoor items unusable do not qualify for a refund, but alternative options may be suggested.
The Company reserves the right to refuse outdoor item hire on the day of the event if adverse weather conditions pose a safety risk.
15. Photography
Images of our handmade or hired items are for private use only. If shared on social media, please tag us @handmadeandhire. For featuring our items in promotional materials, written permission must be obtained from the Company. The Company may take event photographs for marketing purposes, with prior
permission. The Hirer has the right to refuse marketing photos.
16. Waiver of Liability
By signing this agreement, the Hirer releases ‘The Handmade & Hire Company Limited’ from any liability related to injuries during the event. The Hirer agrees not to hold the Company responsible for any liability, including financial, for injuries incurred during the event or caused by negligence and agrees to comply with all relevant safety regulations and guidelines during the event. All hired items should be overseen by a responsible adult (over 18 years old) during the event.
17. Complaints
All complaints must be submitted in writing and will be acknowledged within 14 working days.
18. Confidentiality
All personal details of the Hirer(s) will be kept securely unless otherwise requested by the Hirer. Email data
will be kept for use by the Company unless the Hirer opts out by emailing hello@handmadeandhire.co.uk.
19. Copyright
All wording and images on our website and social media are Copyright to ‘The Handmade & Hire Company Limited’.
20. Disclaimer
Users of our equipment do so at their own risk. ‘The Handmade & Hire Company Limited’ accepts no responsibility for any injury caused during the hire.
By paying a deposit to The Handmade & Hire Company Limited, you acknowledge, understand, and agree to abide by the terms and conditions outlined above. This acknowledgement signifies a legally binding agreement between you and The Handmade & Hire Company Limited.
The Company reserves the right to amend these terms and conditions at any time.
